1. THE PLATFORM
a. This commercial platform is owned by the company Hidro Orfão - Hydraulic Solutions Lda (PT504050931), accessible through the domains www.hidraulica.pt and www.lojadehidraulica.pt.
b. The supplier of the goods traded on this platform is Hidro Orfão - Hydraulic Solutions Lda, located at Rua Dionísio Rodrigues, nº110, 2415-801 Leiria, with the phone number +351 244 882 110 (call to the national fixed network), fax +351 244 881 399, and the email address geral@hidroorfao.pt.
2. OBJECT AND SCOPE OF APPLICATION
a. All orders placed and accepted by Hidro Orfão, Lda through this platform are governed by these Terms and Conditions of Sale.
b. By placing an order, the Customer acknowledges that they have read, understood, and accepted these Terms and Conditions of Sale without reservation by checking the respective field.
c. Hidro Orfão reserves the right to change these Terms and Conditions of Sale at any time and without prior notice by publishing a new version.
3. REGISTRATION AND PASSWORD
a. Registration on this page will require the provision of some data, which the Customer is responsible for ensuring is correct, complete, and up-to-date.
b. The data provided may include personal data necessary for the fulfillment of legal and contractual obligations (such as issuing invoices and dispatching orders), which will be processed under legal terms.
c. When registering, you will be asked to set an access password, which must be kept strictly confidential and not disclosed or shared with third parties.
d. The Hidro Orfão team does not have access to any record of passwords; thus, updating and changing them is entirely the Customer's responsibility.
e. Hidro Orfão is not responsible for the misuse of your account or for any order placed with it.
f. If you suspect that your account is being used or accessed improperly, you should immediately contact the Hidro Orfão team.
4. PRICES
a. All prices of goods displayed on the websites (www.lojahidraulica.pt or www.hidraulica.pt) include VAT at the legal rate in force (prices with VAT).
b. All amounts are presented in € euros.
c. In addition to the price of the goods, packaging charges (if any), transportation, postage, or delivery charges provided during the ordering process and before its completion will be added.
d. Due to potential fluctuations in price and stock values, the price of the item will only be guaranteed after order confirmation, which can be downloaded or printed.
e. Hidro Orfão reserves the right to cancel any order that has errors, such as pricing, calculation, writing, or printing errors, with due notice to the Customer.
f. The charges and expenses referred to in point c.) of this clause will be charged according to the price list in force on the date of the order completion, that is, with the values indicated on this page on the date you place your order, and will be calculated based on the size of the order and the chosen delivery method.
g. Hidro Orfão reserves the right to change its prices and shipping costs at any time.
h. The prices displayed on the websites (www.lojahidraulica.pt or www.hidraulica.pt) are exclusive for online orders and may differ from the prices charged in physical stores.
5. PAYMENT AND ORDER VALIDATION
a. This platform has several payment methods available, namely:
i. Multibanco (ATM)
ii. Payment upon delivery (available only for in-store pickup and deliveries within mainland Portugal)
b. The amount to be paid will be the total sum of the price of the goods, including taxes and duties, and packaging charges (if any), transportation, postage, or delivery charges, and other applicable fees.
c. We make every effort to ensure the maximum confidentiality and security of the data transmitted over the internet.
d. Upon confirmation of receipt of payment, a confirmation email will be sent, and the respective shipment will be processed within the following 24 business hours.
e. Hidro Orfão reserves the right to refuse any order, regardless of the reason, and is exempt from liability for any damages or costs. It also reserves the right to cancel any purchase even if it has already been accepted or confirmed, particularly for the following reasons:
i. The information provided is incorrect or unverifiable;
ii. The order is flagged by the platform's Security Systems as incorrect, irregular, or potentially fraudulent;
iii. The transfer/payment of the order is not received within 5 business days following order acceptance;
iv. It is not possible to deliver the order to the provided address;
v. An error is detected on the page, such as calculation, price, or stock errors.
f. The data on the invoice is the sole responsibility of the Customer. After issuance, the invoice cannot be reissued with changes.
6. DELIVERY AND ORDER VERIFICATION
a. All orders placed will be shipped to the delivery address specified for each order unless in-store pickup is selected.
b. The time until the order is dispatched will depend, among other things, on the payment method's processing speed.
c. In the customer area, it is possible to check the history and status of each order.
d. The shipping service is carried out by third parties, and Hidro Orfão is not responsible for any damages or losses of the order(s) or for delays in their delivery.
e. Hidro Orfão will properly package the goods and provide the tracking number so that the customer can monitor the goods or contact the carrier if necessary. The tracking number can be checked in the order history of the customer area.
f. It is the Customer's responsibility to verify the conformity of the order and its condition upon delivery.
7. RIGHT OF WITHDRAWAL
a. The customer has the right to withdraw from the purchase and sale contract made through this platform without providing a reason, which can be exercised by making an unequivocal statement of withdrawal within 14 days from the date:
i. On which the customer or a third party, other than the carrier, acquires physical possession of the goods;
ii. On which the customer or a third party, other than the carrier, acquires physical possession of the last item in the case of several goods ordered in a single order and delivered separately.
b. The returned item must be intact, without damage or signs of use.
c. Returns must be accompanied by a copy of the invoice.
8. WARRANTIES
a. In case of non-conformity of the goods with the contract, the consumer customer has the right to have the conformity restored without charge, through repair or replacement, within the legal warranty period of two years from the delivery of the goods, except when an agreement for a one-year period applies for used goods.
b. Non-consumer customers are excluded from the warranty.
9. CLAIMS
a. The customer can submit claims to Hidro Orfão in writing via email or postal mail.
10. INTELLECTUAL PROPERTY
a. All content on this page is the intellectual property of Hidro Orfão – Hydraulic Solutions, Lda.
11. FORCE MAJEURE
Hidro Orfão will make all reasonable efforts to fulfill its obligations but cannot be held liable for delays caused by circumstances beyond its control.
12. APPLICABLE LAW AND JURISDICTION
These General Terms and Conditions of Sale are governed by Portuguese law.
13. ALTERNATIVE DISPUTE RESOLUTION
In case of consumer disputes, the consumer can contact the European Online Dispute Resolution Platform at http://ec.europa.eu/consumers/odr.
